Terms of Service

These Terms of Service ("Terms") govern access to and use of the BookIQ platform, including any booking website, SMS messaging, calendar integration, and AI phone agent services (collectively, the "Service") provided by BookIQ ("BookIQ," "we," "us," or "our"). By engaging BookIQ or using the Service, you agree to these Terms.

1. The Service

BookIQ provides appointment-based businesses ("Clients") with a managed booking and client retention platform, which may include a branded booking website, automated SMS messaging, calendar synchronization, an AI phone booking agent, and related retention tooling. BookIQ operates this infrastructure on behalf of each Client under a separate services arrangement.

2. SMS Messaging & Consent

Where a Client's customers ("End Users") provide a phone number through a BookIQ-powered booking flow, they consent to receive appointment-related text messages (confirmations, reminders, and related notifications) from that Client via BookIQ's messaging systems. Message frequency varies by appointment activity. Message and data rates may apply. End Users may opt out at any time by replying STOP to any message, or by contacting the Client directly. Reply HELP for assistance.

3. Client Responsibilities

Clients are responsible for the accuracy of business information, service listings, and availability provided to BookIQ, and for ensuring their use of the Service complies with applicable law, including obtaining any consents required from their own customers.

4. Data Handling

BookIQ processes limited personal information (such as name, phone number, and appointment history) strictly to operate the Service on a Client's behalf. See our Privacy Policy for details on what is collected and how it is used.

5. Third-Party Services

The Service relies on third-party infrastructure providers, including but not limited to Twilio (messaging), Google Calendar (scheduling), and hosting/automation providers, to deliver its functionality. BookIQ is not responsible for outages or limitations caused by these third-party providers.

6. Availability

BookIQ aims for high availability but does not guarantee uninterrupted access to the Service. Scheduled maintenance and factors outside BookIQ's control may affect availability.

7. Limitation of Liability

To the maximum extent permitted by law, BookIQ's liability arising from use of the Service is limited to the fees paid by the Client for the Service in the three (3) months preceding the claim. BookIQ is not liable for indirect, incidental, or consequential damages, including lost revenue or missed appointments.

8. Termination

Either party may terminate a Client's use of the Service as set out in the applicable services agreement. Upon termination, BookIQ will reasonably assist with an orderly transition of booking data.

9. Changes to These Terms

BookIQ may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
